Welcome to Best Deals! By using our services, you agree to be bound by the following terms and conditions. Please read them carefully.
This User Agreement and Privacy Policy (the "Terms") outline how you can access and use our website and mobile application (the "Platform").
The Terms apply regardless of how you access the Platform or what device you use. Additional terms may apply to specific products, services, offers, or contests on our Platform.
By clicking "Accept" below, you agree that you have read, understand, and will comply with the Terms to access and use the Best Deals Platform, including our website and mobile app.
We have tried to write the Terms clearly and simply. Please contact us if any part is unclear or if you have any other questions.
Your statutory legal rights as a consumer are not affected by these Terms.
1. Eligibility:
1.1 You must be at least 18 years old to use Best Deals. You represent and warrant that you have the legal right, authority, and capacity to enter into and abide by the terms of this agreement.
1.2 You must provide accurate information during the registration process. Providing false identities or inaccurate information may result in the termination of your account.
1.3 You must have a valid payment method on file, such as a credit or debit card, to complete purchases through Best Deals.
1.4 Best Deals reserves the right to refuse service, terminate accounts, remove or edit content, cancel orders, or change these eligibility terms at any time for any reason at its sole discretion.
1.5 Your continued use of the site following any changes to the eligibility terms will constitute your acceptance of those changes.
2. Membership and Registration:
You must register for a user account to access certain features of the Best Deals website and services.
2.1 As part of the registration process, you will be asked to select a unique username and password. You are responsible for maintaining the confidentiality of your username and password and for any activity under your account.
2.2 You agree to provide accurate, current, and complete information about yourself during the registration process and to update such information to keep it accurate, current, and complete.
2.3 You agree not to impersonate any other person or entity, or to provide false or misleading information during registration or your use of the services.
2.4 We reserve the right to refuse registration of, or cancel, any username that we deem inappropriate or offensive.
2.5 You are responsible for maintaining the confidentiality of your account and password.
You agree not to use the account, username, or password of another user at any time or to disclose your password to any third party.
2.6 You agree to immediately notify Best Deals if you discover unauthorized use of your account or password.
2.7 You are responsible for all content posted and activity that occurs under your account.
2.8 Your membership is for your personal use only and you may not authorize others to use your membership.
2.9 You must notify us immediately if you become aware of any unauthorized use of your account or any other breach of security.
2.10 We may terminate your membership or ability to access or use the services at any time for any reason.
2.11 You are solely responsible for your interactions with other Best Deals members or third parties. We reserve the right, but have no obligation, to monitor disputes between you and other members.
3. Electronic Communication:
To fulfill our obligations to you under these Terms, we may wish to communicate with you by email, by other forms of electronic messaging, and/or by posting notices on the Platform. You agree to receive communications from us electronically and these electronic communications will satisfy any legal requirement for communications that need to be in writing.
4. Your Use of The Platform:
4.1 You may not access or use the Platform or the Services for any purpose other than the purpose for which we make the Platform or the Services, as applicable, available to you and you may not use either the Platform or the Services in a way that infringes the rights of anyone else or that restricts or inhibits anyone else's enjoyment of the Platform.
4.2 Without limiting the generality of clause 4.1, when accessing the Platform, or using our Services, you should not:
4.2.1 post or transmit false, inaccurate, misleading, defamatory, or libelous content (including but not limited to during the registration process);
4.2.2 violate any third-party rights, including intellectual property rights;
4.2.3 advertise to, or solicit, any user to buy or sell any Services, except with the express written approval of us;
4.2.4 transmit chain letters or junk email to other users;
4.2.5 use any information obtained from the Services to contact, advertise to, solicit, or sell any products or services to any user without their prior explicit consent;
4.2.6 attempt to impersonate another user or person;
4.2.7 use the username or account of another user;
4.2.8 use any information obtained from the Services and Platform in order to harass, abuse or harm another user or person;
4.2.9 accepting payment of anything of value from a third person in exchange for your performance of any commercial activity on or through the Services on behalf of that person;
4.2.10 use the Platform in a manner inconsistent with any and all applicable laws and regulations; and
4.2.11 otherwise, incur any liability to the Platform or us.
4.3 You may not copy, modify, distribute, sell, or lease any part of the Platform. Unless the law prohibits such restriction or you have our written permission, you may not reverse engineer or attempt to extract the source code of the Platform. You may only access the Platform through the interfaces that we provide for that purpose (for example, you may not "scrape" the Platform through automated means or "frame" any part of the Platform), and you may not interfere or attempt to disrupt the Platform.
4.4 You may not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform, or to any of the Services offered on or through the Platform, by hacking, password "mining" or any other illegitimate means.
4.5 You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Platform our systems or networks, or any systems or networks connected to the Platform or us.
4.6 You agree not to use any device or software to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform or with any other person's use of the Platform.
5. Payment and Refund:
5.1 If you make a payment for one of our Services available on our Platform, the details you are asked to submit will be provided directly to our payment provider via a secured connection. Please ensure you have read the applicable terms and conditions provided by your bank before the transaction.
5.2 Multiple transactions by you on our Platform may result in multiple postings to your monthly credit or debit card statement.
5.3 The product prices displayed on our Platform are inclusive of VAT. You may be charged in AED (United Arab Emirates Dirham) or US Dollar (United States Dollar) depending on where you are using the Platform from and what type of credit or debit card you are using.
In such cases, there may be slight discrepancies in values due to changes in foreign exchange rates.
5.4 We are not responsible and shall not compensate you for any loss that occurs due to these rate fluctuations.
5.5 Best Deals gives no warranties or representations whatsoever about the exchange rates it provides for any transaction and is under no obligation to provide the best or most competitive exchange rates available.
5.6 Once you purchase any gift cards that is not refundable you have to enter a draw or redeem it from any vendor store.
5.7 For any defective products sold by Best Deals, we will offer you a remedy in compliance with applicable laws. You acknowledge and agree that any refunds requested by you may affect your participation in Draws and your chance to win Prizes (as set out in more detail in the Draw Terms). This is because your entry into the Draws is directly correlated to your purchase of the products and Services available on the Platform.
6. Intellectual Property Rights:
6.1 The Platform and the materials on the Platform, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and the like ("Materials") and the trademarks, service marks, and logos contained therein ("Marks"), are owned by or licensed to Best Deals for Gift Trading LLC and are subject to copyright and other intellectual property rights under UAE and foreign laws and international conventions.
6.2 In connection with the Services, the Platform may display certain content belonging to third parties. Use of this content may be subject to a license granted by third parties to Best Deals. You shall, in no event, reverse engineer, decompile, or disassemble such content and nothing herein shall be construed to grant you any right with such content. Materials on the Platform are provided to you "as is" for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcasted, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.
6.3 Best Deals reserves all rights not expressly granted herein to the Platform and the Materials. You agree to not engage in the use, copying, or distribution of any of the Materials other than as expressly permitted herein, including any use, copying, or distribution of Materials of third parties obtained through the Platform for any commercial purposes. You agree not to circumvent, disable, or otherwise interfere with security-related features of the Platform or features that prevent or restrict the use or copying of any Materials or enforce limitations on the use of the Platform or the Materials therein.
6.4 Content displayed on or through the provision of the Services is protected by copyright as a collective work and/or compilation, according to copyright laws, other laws, and international conventions. Any reproduction, modification, creation of derivative works from or redistribution of the Platform, the Materials, or the collective work or compilation is expressly prohibited. Copying or reproducing the Platform, the Materials, or any portion thereof for further reproduction or redistribution is expressly prohibited.
6.5 You will be exposed to Materials from a variety of sources, and, as far as the applicable law allows, Best Deals is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Materials, and you agree and assume all liability for your use of any such Materials.
7. Disclaimer of Warranty:
7.1 To ensure a reliable and positive user experience, we perform regular system maintenance which may involve fixing bugs, installing updates, and conducting general diagnostics.
However, we cannot guarantee that the Platform or Services will always function flawlessly without interruption, issues, omissions, or errors. Unless restricted by law, the Platform, Services, and all related content are provided on an "as is" basis without warranties of any kind, whether express or implied.
7.2 The information provided on the Platform is intended for general informational purposes only. While we strive to keep all data accurate in collaboration with our partners, we cannot guarantee its completeness or currency. You understand and agree that your use of the Platform and reliance on any information is solely at your own risk.
8. Limitations of Liability:
8.1 To the maximum extent permitted by law, we will not be responsible for:
- Any claims regarding infringement, disputes over transactions, quality, safety, breach of warranty, or payments related to your use of the Platform.
- Any direct, indirect, punitive, incidental, special, or consequential damages arising from your use of or inability to use the Platform and Services.
- Damages caused by technical issues outside our control that affect the Platform.
8.2 We expressly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.3 Our maximum aggregate liability for any claims arising from your use of the platform and services is AED 100, regardless of the basis of the claim.
8.4 The limitations in this section apply to the fullest extent permitted by law and will survive and apply even if any limited remedy fails to fulfill its essential purpose.
9. Indemnity:
You agree to defend, indemnify, and hold harmless Best Deals and its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to reasonable attorneys’ fees) arising from or relating to:
(i) your use of the Platform or Services in violation of this Agreement;
(ii) your violation of any law, rule, or regulation, or the rights of any third party;
(iii) any content or materials that you submit, post, or transmit through the Platform or Services.
This indemnification obligation will survive the termination of this Agreement and your use of the Platform and Services.
10. Limitation and Termination of Access:
10.1 Best Deals reserves the right to limit certain features of the Services from time to time, such as storage space, posting/message limits, and access frequency.
10.2 Best Deals may modify, suspend, or discontinue any aspect of the Services at any time without notice and liability.
10.3 Upon termination of your account by either party, your authorization to access the Platform and Services will end immediately. We may limit your access during a pending termination.
10.4 You agree to promptly notify us of any unauthorized access to your account or security breach related to your use of the Services.
10.5 Termination of your access shall not affect our rights or relieve you of any obligations arising before or as a result of the termination.
10.6 We reserve the right to take technical and legal steps to enforce termination of your access as necessary.
11. Force Majeure:
11.1 We shall not be liable for any delay, failure in performance, or disruption of the services or platform resulting directly or indirectly from causes beyond our reasonable control ("force majeure events"). Force Majeure Events include acts of God; natural disasters; pandemics; acts of war, terrorism, riots, or civil unrest; strikes or labor actions; governmental orders or restrictions; shortages of materials, labor, or supplies; disruptions to telecommunications or internet services or networks; or non-performance of third parties.
11.2 We will make reasonable efforts to avoid or remove such causes of non-performance. This provision shall not apply to payment obligations under this agreement.
12. General Provisions:
12.1 Severability: If any part of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.
12.2 No Waiver: Our failure to enforce any part of these Terms is not a waiver of our right to later enforce that or any other part.
12.3 Assignment: You may not assign your rights or obligations without our written consent. We may assign our rights without consent or notice.
12.4 Third Party Rights: No third party has any rights under these Terms.
13. GOVERNING LAW AND DISPUTE RESOLUTION:
13.1 The Terms shall be governed by and construed under the laws of the Dubai International Financial Centre ("DIFC"), Dubai, United Arab Emirates
13.2 These terms may be published in English and Arabic. If there is any inconsistency between the English text and the Arabic text, the English text will prevail.

4,2,8 استخدام أي معلومات مكتسبة من الخدمات والمنصة لمضايقة أو إيذاء مستخدم آخر.
4,2,9 قبول أي مقابل مادي من طرف ثالث مقابل أداء أي نشاط تجاري عبر الخدمات نيابة عنه.
4.2.10 استخدام المنصة بطريقة غير متوافقة مع القوانين واللوائح.
4,2,11 خلاف ذلك، تكبد أي مسؤولية تجاه المنصة أو جهتنا.
4.3 لا يمكنك نسخ أو تعديل أو توزيع أو بيع أو تأجير أي جزء من المنصة. ما لم يحظر القانون مثل هذا التقييد أو يكون لديك إذن مكتوب، فلا يمكنك عكس المهندس أو محاولة استخراج الكود المصدري للمنصة. يمكنك فقط الوصول إلى المنصة من خلال الواجهات التي نقدمها لهذا الغرض (على سبيل المثال،

4.6 تتفق على عدم استخدام أي جهاز أو برنامج للتدخل أو محاولة التدخل في العمل الصحيح للمنصة أو أي صفقة تتم على المنصة أو استخدام أي شخص آخر للمنصة.
5. الدفع والاسترداد:
5.1 إذا قمت بالدفع مقابل إحدى خدماتنا المتاحة على منصتنا، فسيتم تقديم التفاصيل التي يُطلب منك تقديمها مباشرة إلى مزود الدفع الخاص بنا عبر اتصال مضمون. يرجى التأكد من قراءة الشروط والأحكام المعمول بها التي قدمها البنك الخاص بك قبل المعاملة.
5.2 قد تؤدي المعاملات المتعددة التي تجريها على منصتنا إلى عمليات نشر متعددة في بيان بطاقة الائتمان أو الخصم الشهري.
5.3 أسعار المنتجات المعروضة على منصتنا شاملة لضريبة القيمة المضافة. قد يتم فرض رسوم عليك بالدرهم الإماراتي (الإمارات العربية المتحدة) أو الدولار الأمريكي (دولار الولايات المتحدة) اعتمادًا على المكان الذي تستخدم فيه المنصة ونوع بطاقة الائتمان أو الخصم التي تستخدمها.
وفي هذه الحالات، قد تكون هناك اختلافات طفيفة في القيم بسبب التغيرات في أسعار صرف العملات الأجنبية.
5.4 لسنا مسؤولين ولن نعوضك عن أي خسارة تحدث بسبب تقلبات الأسعار هذه.
5.5 لا تقدم بيست ديلز أي ضمانات أو إقرارات على الإطلاق بشأن أسعار الصرف التي توفرها لأي معاملة وليس ملزمًا بتقديم أفضل أو أكثر أسعار الصرف المتاحة تنافسية.
5.6 بمجرد شراء أي بطاقات هدايا غير قابلة للاسترداد، عليك الدخول في سحب أو استردادها من أي متجر بائع.

6. حقوق الملكية الفكرية:

6.2 في إطار الخدمات، قد تعرض المنصة محتوى ينتمي لأطراف ثالثة. استخدام هذا المحتوى قد يخضع لترخيص ممنوح من الأطراف الثالثة لشركة بيع أفضل. لن تقوم أبداً بفك تجميع أو تفكيك أو تعديل مثل هذا المحتوى ولا يمكن تفسير أي شيء هنا على أنه يمنحك أي حق في مثل هذا المحتوى. تزودك المنصة بالمواد "كما هي" للاستخدام المعلوماتي والشخصي فقط ولا يمكن استخدامها أو نسخها أو إنتاجها أو توزيعها أو بثها أو عرضها أو بيعها أو ترخيصها أو استغلالها بأي طريقة أخرى دون الحصول على موافقة كتابية مسبقة من المالكين المعنيين.
6.3 تحتفظ شركة بيست ديلز بكافة الحقوق غير الممنوحة صراحة هنا في المنصة والمواد. توافق على عدم القيام باستخدام أو نسخ أو توزيع أي من المواد بخلاف ما هو مسموح به صراحة هنا بما في ذلك أي استخدام أو نسخ أو توزيع لمواد الأطراف الثالثة المكتسبة من خلال المنصة لأي أغراض تجارية. توافق على عدم التحايل على أو تعطيل أو التدخل بأي وسيلة مع ميزات أمنية في المنصة أو ميزات تمنع أو تقيد استخدام أو نسخ أي مواد أو فرض قيود على استخدام المنصة أو المواد الموجودة فيها.
6,4 المحتوى المعروض على أو من خلال تقديم الخدمات محمي بحقوق التأليف والنشر كعمل جماعي و/أو تجميع، وفقًا لقوانين حقوق النشر والقوانين الأخرى والاتفاقيات الدولية. يحظر صراحة أي استنساخ أو تعديل أو إنشاء أعمال مشتقة من المنصة أو المواد أو العمل الجماعي أو التجميع أو إعادة توزيعها. يحظر صراحة نسخ أو استنساخ المنبر أو المواد أو أي جزء منها لمزيد من الاستنساخ أو إعادة التوزيع.
6.5 ستتعرض للمواد من مجموعة متنوعة من المصادر، وبقدر ما يسمح به القانون المعمول به، فإن أفضل الصفقات ليست مسؤولة عن الدقة أو الفائدة أو السلامة أو حقوق الملكية الفكرية لهذه المواد أو المتعلقة بها، وأنت توافق وتتحمل جميع المسؤولية عن استخدامك لأي من هذه المواد.
7. إخلاء المسؤولية عن الضمان:
7.1 لضمان تجربة مستخدم موثوقة وإيجابية، نقوم بصيانة النظام بانتظام والتي قد تتضمن إصلاح الأخطاء وتركيب التحديثات وإجراء التشخيصات العامة.
ومع ذلك، لا يمكننا ضمان أن المنصة أو الخدمات ستعمل دائمًا بشكل لا تشوبه شائبة دون انقطاع أو مشاكل أو إغفالات أو أخطاء. ما لم يقيد القانون، يتم توفير المنصة والخدمات وجميع المحتويات ذات الصلة على أساس «كما هو» دون ضمانات من أي نوع، سواء كانت صريحة أو ضمنية.
7,2 المعلومات المقدمة على المنصة مخصصة لأغراض إعلامية عامة فقط. بينما نسعى جاهدين للحفاظ على دقة جميع البيانات بالتعاون مع شركائنا، لا يمكننا ضمان اكتمالها أو عملتها. أنت تفهم وتوافق على أن استخدامك للمنصة والاعتماد على أي معلومات هو فقط على مسؤوليتك الخاصة.
8. حدود المسؤولية:
8,1 إلى أقصى حد يسمح به القانون، لن نكون مسؤولين عما يلي:
- أي مطالبات تتعلق بالتعدي أو النزاعات على المعاملات أو الجودة أو السلامة أو خرق الضمان أو المدفوعات المتعلقة باستخدامك للمنصة.
- أي أضرار مباشرة أو غير مباشرة أو عقابية أو عرضية أو خاصة أو تبعية ناجمة عن استخدامك أو عدم قدرتك على استخدام المنصة والخدمات.
- الأضرار الناجمة عن مشاكل فنية خارجة عن إرادتنا وتؤثر على المنصة.
8,2 نتنصل صراحة من جميع الضمانات، سواء كانت صريحة أو ضمنية، بما في ذلك ضمانات قابلية التداول، واللياقة البدنية لغرض معين، وعدم التعدي.
8.3 الحد الأقصى لمسؤوليتنا الإجمالية عن أي مطالبات ناشئة عن استخدامك للمنصة والخدمات هو 100 درهم إماراتي، بغض النظر عن أساس المطالبة.
8,4 تنطبق القيود الواردة في هذه المادة إلى أقصى حد يسمح به القانون وستستمر وتطبق حتى إذا لم يف أي سبيل محدود من سبل الانتصاف بالغرض الأساسي منها.
9. التعويض:
أنت توافق على الدفاع عن شركة بيست ديلز والشركات التابعة لها وتعويضها وعقدها بشكل غير ضار، ومسؤوليها ومديريها وموظفيها ووكلائها، من وضد جميع المطالبات والأضرار والالتزامات والخسائر والالتزامات والتكاليف أو الديون والنفقات (بما في ذلك على سبيل المثال لا الحصر أتعاب المحامين المعقولة) الناشئة عن أو المتعلقة بما يلي:
'1' استخدامك للمنصة أو الخدمات بمخالفة هذا الاتفاق.
'2' مخالفتك أي قانون أو قاعدة أو لوائح أو حقوق أي طرف ثالث.
'3' أي محتوى أو مواد قدمتها أو نشرتها أو أرسلتها من خلال المنصة أو الخدمات.
سيبقى هذا الالتزام بالتعويض ساري المفعول بعد انتهاء هذا الاتفاق واستخدامك للمنصة والخدمات.
10. تقييد وإنهاء الوصول:
10.1 تحتفظ أفضل الصفقات بالحق في تقييد ميزات معينة للخدمات من وقت لآخر، مثل مساحة التخزين، وحدود النشر/الرسالة، وتردد الوصول.
10.2 يجوز لشركة بيست ديلز تعديل أو تعليق أو وقف أي جانب من جوانب الخدمات في أي وقت دون إشعار ومسؤولية.
10.3 عند إنهاء حسابك من قبل أي من الطرفين، سينتهي إذنك بالوصول إلى المنصة والخدمات على الفور. قد نحد من وصولك خلال فترة إنهاء معلقة.
10.4 توافق على إخطارنا على الفور بأي وصول غير مصرح به إلى حسابك أو خرق أمني يتعلق باستخدامك للخدمات.
10,5 لا يؤثر إنهاء وصولك على حقوقنا أو يعفيك من أي التزامات تنشأ قبل الإنهاء أو نتيجته.
10.6 نحتفظ بالحق في اتخاذ خطوات تقنية وقانونية لإنهاء وصولك حسب الضرورة.
11. القوة المسيطرة :
11.1 لن نكون مسؤولين عن أي تأخير أو عدم القدرة على تنفيذ الالتزامات أو اضطراب في الخدمات أو المنصة الناتج مباشرة أو غير مباشرة عن أسباب خارجة عن سيطرتنا المعقولة ("أحداث القوة المسيطرة"). تشمل أحداث القوة المسيطرة/ القاهرة : أعمال الله؛ الكوارث الطبيعية؛ الجوائح؛ أعمال الحرب أو الإرهاب أو الشغب أو الاضطرابات المدنية؛ الإضرابات أو الإجراءات العمالية؛ الأوامر أو القيود الحكومية؛ نقص المواد أو العمالة أو المواد الخام؛ اضطرابات خدمات أو شبكات الاتصالات أو الإنترنت؛ أو عدم أداء الأطراف الثالثة لالتزاماتها.
11.2 سنبذل جهودا معقولة لتجنب أو إزالة مثل هذه الأسباب التي تمنع التنفيذ. لا تنطبق هذه الشروط على الالتزامات المتعلقة بالدفع وفقا لهذا الاتفاق.
12. أحكام عامة:
12.1 الفصل: إذا تم تحديد أي جزء من هذه الشروط على أنه غير صالح أو غير قابل للتنفيذ، فستبقى باقي الأحكام سارية المفعول.
12.2 عدم التنازل: فشلنا في تطبيق أي جزء من هذه الشروط لا يعد تنازلا عن حقنا في تطبيقه لاحقًا أو أي جزء آخر.
12.3 التنازل: لا يمكنك تحويل حقوقك أو التزاماتك دون موافقتنا المكتوبة. يمكننا تحويل حقوقنا دون موافقة أو إشعار.
12.4 حقوق الأطراف الثالثة: لا يملك الأطراف الثالثة أي حقوق بموجب هذه الشروط.
13. القانون الواجب التطبيق وحل المنازعات:
13.1تخضع الشروط وتُفسر وفقاً لقوانين مركز دبي المالي العالمي ("DIFC")، دبي ، الإمارات العربية المتحدة.
13.2 يمكن نشر هذه الشروط باللغتين الإنجليزية والعربية. في حالة وجود أي تعارض بين النص الإنجليزي والنص العربي، يتم الرجوع إلى النص الإنجليزي.
